To ensure this, we offer a voluntary mediation process that enables out-of-court dispute resolution. This page explains how you can utilize our mediation services to address conflicts related to the use of the platform www.chasemyplace.at.

What is Mediation?

Mediation is a voluntary process in which a neutral third party (mediator) assists the parties in finding a mutually agreeable solution to their dispute. Unlike a court proceeding, mediation is confidential, less formal, and often faster and more cost-effective. It aims to consider the interests of both parties and work toward a solution acceptable to everyone.

When is Mediation Suitable?

Mediation is particularly suitable for disputes arising in connection with the use of our platform, such as:

  • Disagreements regarding the posting or deactivation of property listings.
  • Complaints about the billing of services (e.g., "Price Plan").
  • Misunderstandings concerning the terms of use (B2B Terms or Consumer Terms).
  • Conflicts over communication or data processing on the platform. Please note that mediation does not exclude the legal route. You may initiate legal proceedings at any time if no agreement is reached.

How Does Our Mediation Process Work?

  • Contact To initiate a mediation process, please contact us in writing and describe the matter as detailed as possible. You can submit your request to the following address: ChaseMyPlace Kft.

    Please include the following information in your request:
    • Your name and contact details (e.g., email address, username, or pseudonym on the platform).
    • A description of the issue, including relevant data (e.g., date of listing deactivation, invoice number).
    • Your desired solution or goal for the mediation.
  • Review of the Request We will confirm receipt of your mediation request within five working days and assess whether your concern is suitable for a mediation process. If mediation is not possible or suitable (e.g., for purely legal questions), we will inform you of alternative options, such as our complaint management system (see www.chasemyplace.at/contact) or the possibility of pursuing legal action.
  • Selection of the Mediator If your concern is suitable for mediation, we will propose an independent mediator within ten working days. The mediators are qualified professionals with experience in dispute resolution and have no affiliation with ChaseMyPlace. You may agree to the proposal or suggest an alternative mediator. We collaborate with the following mediation bodies:

    • European Mediation Office for Consumers: www.euro-mediation.eu
  • Conduct of the Mediation After selecting the mediator, we will schedule a mediation session, which can take place in person in Budapest, via video conference, or in writing. During the mediation, the mediator supports both parties in finding a mutually agreeable solution. The duration of the process depends on the complexity of the case but typically does not exceed 30 days.
  • Conclusion If the parties reach an agreement, it will be documented in a written agreement. This agreement is binding once both parties sign it. If no agreement is reached, you may consider further legal steps. In this case, we will inform you of your options, including the EU Online Dispute Resolution platform (see below).

Costs of Mediation

The costs of mediation are shared between the parties unless otherwise agreed. The exact costs depend on the mediator and the duration of the process and will be communicated to you before the mediation begins. For simple disputes, we offer a free initial consultation in certain cases. Please contact us for further information.

Data Protection

All information submitted during the mediation will be treated confidentially and used solely for the purpose of dispute resolution. Further details on the processing of your data can be found in our privacy policy at www.chasemyplace.at/privacy.

Online Dispute Resolution

Pursuant to Article 14 of Regulation (EU) No. 524/2013, we inform consumers about the European Commission’s Online Dispute Resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr/. Please note that ChaseMyPlace Kft. is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board. Applicable Law and Jurisdiction

For disputes arising from or in connection with the mediation, Hungarian law applies, excluding the UN Sales Convention (CISG). For consumers, the jurisdiction is at their place of residence; an additional jurisdiction is Budapest, Hungary. For commercial users, Budapest, Hungary, is the exclusive jurisdiction.
